About intellectual property law

According to article L111-1 of the French Intellectual Property Code, copyright confers exclusive rights on the author of a work of the mind. As a reminder, copyright comprises two types of rights:

1/ Economic rights, which have a limited duration and can be assigned, and therefore remunerated.

2/ Moral rights, which are perpetual and non-transferable, and cannot be remunerated. Although article L112-2 of the French Intellectual Property Code lists the works of the mind likely to benefit from copyright protection, the website is not expressly mentioned. However, as this list is not exhaustive, the website may benefit from copyright protection if two conditions are met:
The website must be original. In the case of a website, case law has held that “the choice to combine these different elements in a certain presentation is the result of aesthetic research, not imposed by any functional imperative, which gives the site a particular physiognomy distinguishing it from other sites. As such, it represents a creative effort that characterizes the site’s originality.

The website must be materialized, i.e. sufficiently elaborate. The choice of colors, shapes, graphics and layout gives it an elaborate character. It’s worth remembering that no formalities are required for a work to benefit from copyright protection, as this protection exists solely by virtue of the creation of the work.
